Have the new site owners the right to move us from our existing plot?

Our site was sold last year and we are unsure if our previous 20 years’ lease contract will still be valid with the new owners. There is a lot of redevelopment work taking place, whereby quite a number of caravans have been taken off their existing plots and moved to other areas of the site. Some of the owners were given just two or three weeks’ notice that they were going to be moved.

Have the new owners the right to move us from our existing plot and does our contract with the previous owner still stand?

Can the site owner force you to sell to them?

I have a mobile home sited on a small, privately owned site. However, on receiving the agreement (a month after moving in) I noted home owners must only sell to the site owner.

Other home owners have confirmed this rule is rigorously enforced and the price offered is rock bottom. If you do sell to someone other than the owner then the home must be removed. Can the site owner force you to sell to them? Most of the residents here are unhappy with the agreement but are resigned, as am I, to the fact we signed the agreement so there is no way out.

What happens if your pitch fees are in arrears?

One of the members of our residents’ association, since the loss of his wife, has allowed himself to get into arrears with his rent and bills. The owners have issued him with a solicitor’s letter stating that if he does not pay what he owes within seven days they will cut both his electric and water supply. I have checked our site agreement which states we must pay our pitch fee weekly or monthly in advance. There is no mention of arrears. Is the action taken by the park owners legal, and, is there any other advice you could give to help solve this problem?

I was sold a holiday home as a residential home, is this legal?

Two years ago, I put a deposit on a residential home. I have since found out that I’m living in a holiday home built to either E1647 or LN1647 standard. This home was originally advertised by the site owners as a holiday home and marketed for sale at between £60,000 and £70,000. When the park’s residential licence came through the owners said the home was residential and then doubled the advertised sale price! I’ve spoken to the park managers but they wont accept they have done anything wrong. Is there anything I can do to get the park owners to accept responsibility for falsely selling me this home?

What are the park home laws for will beneficiaries

I am hoping to purchase a park home so that my good friend can move in with me. I will put his name on the agreement with mine, so if I should pass away before him he can continue living there.

Wills would have already have been made so that when he passes away the home reverts back to my beneficiaries. Will park home laws allow this, even though we are not partners?

Do I have any grounds for recovery of my deposit

I placed a deposit on a new home to be sited on a vacant plot. The paperwork clearly stated that it was non-refundable. Later we asked if we could transfer our purchase to an existing property on the site, which was agreed. There were never any strings attached, no terms and conditions and certainly no timelines.

Without any other correspondence being entered into, this property was then sold. My opinion is that it breached the ‘contract’ as it was unreasonable to do it without our knowledge or

prior agreement. Do I have any grounds for recovery of my deposit?

Can our park owner cut our gas supply?

Residents on the park I live on have been advised that the bulk LPG tanks on our site will be removed in autumn 2009. We have been told we have to sign a new contract or our gas supply will be disconnected. Please could you advise us if this is legal or not?

I was assured the 10 per cent commission charge was to be abolished or reduced. This has not happened - where do I stand?

When I bought my park home two and a half years ago, the owner assured me that the 10 per cent commission was soon to be abolished or reduced. I am due to sell my home and feel we pay quite a substantial ground rent and 10 per cent is a lot of money. If, however, the commission was reduced to five per cent it would not be so bad. Also could you inform me as to what percentage site owners can increase the ground rent by?

Can a holiday park site owner charge me for keeping a copy of my insurance policy?

My holiday park site owner wants to charge me for keeping a copy of my insurance policy and an up-to-date insurance certificate. I have looked at my Licence Agreement for a Holiday Caravan Pitch and there is absolutely no requirement for me to insure the holiday caravan with the park site owner. Where do I stand?

Can our park owner cut our water and electric suppplies?

We bought a park home on a holiday park, knowing that it only had a 10- month licence, on the promise a 12-month licence had been applied for. One year on, we still do not have a 12-month residential licence. We then received a letter saying that, to enable the park to gain residential status, they needed separate water and sewage charges from the ground rent. The water charge increased, but as far as I know the owner has not asked any of the other homeowners for extra money. We refused to pay the increase but he threatened to cut the water and electric for the whole park, so we agreed to pay one month’s water charge. Where do we stand?
